不法滞在からの結婚永住権申請

F1ビザで2000年前にアメリカに入国しました。I-94の期限はD/Fですが、I-20切れて9年になります。2003年以降アメリカを出ていません。ESTA、顔写真、指紋最終した事ありません。3年半前にアメリカ市民と結婚したのですかまだ永住権申請してなく(ずっと頼んでいたのですが旦那の収入不安定、税金、スポンサーの件で)、突然最近義母が移民弁護士から、来年の2月までに私と旦那が日本のアメリカ領事館て手続きをして配偶者ビザを申請すればアメリカに戻ってこれると言うのです。
9年不法滞在なのに、なぜわざわさ日本に帰って手続きをしなければならないのか分かりません。再入国拒否されると思いますし、配偶者ビザが承認されるかどうかもわかりません。
旦那と義母は完全にその移民弁護士を信じ切っています。旦那とは付き合いが長くてっきりグリーンカード取得までアメリカに居るつもりだったのですが。私が病気で入退院を繰り返していた為！日本に帰そうとしているとしか思えません。どうすればいいでしようか？

語学学校は、この人は出席してませんから。と報告入れてますからあなたの名前を打ち込めば不法滞在になっており完全なイリーガルです。
こちらに居ても永住権さえも無理です。恩赦があれば別ですが。

トピ主さん、そこまでしてアメリカにいる理由はなんですか？
体調が悪かったのであればなおさら日本に帰ったほうがいいのでは？
働くこともできず、夫婦関係もままならず、長期不法滞在であれば、今後のことも考えて日本に帰る方が人生楽だと思います。
