グリーンカードの申請方法

アメリカ人との結婚でグリーンカードの申請をしようと思ってますが、アメリカ人の彼は内容を読んだら弁護士等を使わなくても自分でできるといっています。自分達で申請してとれるまでの期間が長引いたりとかもしくは専門家に頼まないととりにくいっていうことあるのでしょうか？どなたか経験者いませんか？

ここで「ぱたのうち」をＨＰを参考にするようにという意見がいくつかありましたが、現在はＧＣに関するインフォメーションのコーナーは削除されたようです。
なんでも、「専門家でもないのにＧＣについてアドバイスするのはよくない」という意見があったらしい。確かにＧＣ取得情報は時々で代わって来るので、一番いいのは専門家か、最近取得された方に聞くのが一番だと思います。
でも、弁護士でも人によっていう事が違います。最近取得された方でもシチュエーションによって代わってきますし。
ご自分と似た状況の、最近取得された方を探すのが一番だと思います。
あとはＩＮＳのホームページを参考にされるかですね。
ちなみに私は今年の４月に申請して、６ヶ月で取得しました。

弁護士でもないのに法律アドバイスをHPでしていたら詐欺まがいの行為どころか立派な犯罪ですからね。

GC保持者は犯罪を犯したら強制送還ということをお忘れなく。

GCホルダーさんは6ヶ月でとれたというのはアメリカ人との結婚による申請なのでしょうか？カリフォルニアで申請してでしょうか？それとも日本で？カリフォルニアででしたらやはり、弁護士とかに頼んだのでしょうか？

BAR LEADERS, LEGISLATORS LAUD TOUGHER PENALTIES FOR UNAUTHORIZED PRACTICE OF LAW

San Francisco, September 12, 2002 — Sen. Gloria Romero, D-Los Angeles, and Los Angeles District Attorney Steve Cooley are scheduled to appear at the September 19 meeting of the State Bar's Board of Governors for a special ceremony commemorating the passage of a bill which increases the penalty for the unauthorized practice of law (UPL) by non-lawyers.

Authored by Sen. Romero and signed by Gov. Gray Davis, SB 1459 provides that UPL is punishable by up to one year in county jail or a $1,000 fine or both. Subsequent convictions require a 90-day jail sentence and would require that the court state on the record the reasons for a lesser sentencing.

"I am extremely gratified that the legislature passed, and the governor signed, this very important measure," said State Bar President Karen Nobumoto, who made increased penalties for unauthorized law practice a cornerstone of her presidency.

Nobumoto, a Los Angeles County deputy district attorney, has prosecuted numerous UPL cases. "It is way past the time for cracking down on non-lawyers who hold themselves out as attorneys and provide inadequate services to consumers," she said.

The unauthorized practice of law is a problem particularly in immigrant communities, where unsuspecting individuals hire non-lawyers to handle their legal affairs. The illegitimate businesses promise results and often claim to have inside connections with the Immigration and Naturalization Service.

Both the California attorney general and the Los Angeles district attorney have established programs to target phony practitioners. A new law which took effect last year strengthened consumer protection by requiring immigration consultants to disclose in advertising that they are not lawyers.

The ceremony commemorating the bill's passage will take place at the State Bar's Los Angeles office, 1149 S. Hill St., 2 p.m., 7th floor board room.
