なぜ婚姻ベースで進めなかったかのか・・・雇用ベース申請時に、机上に婚姻ベースのカードが無かったから。現在勤めている会社には、就労ビザで働き始めて5年以上になります。既定の年数勤続すれば、会社がGC申請サポートしてくれるということで、申請し始めたのは結婚を考える前でした。申請のことは会社に任せっきりにしてしまっていて、弁護士チームがゆっくり準備をしている間に、私も長年付き合っていた方と結婚をして、その後COVIDが発生してしまいました。
雇用ベースのプロセス時間について・・・
#1で3ステップに分かれて記載しましたが、「2年」という数字は、ステップ2、3がそれぞれこれくらい時間がかかったという弁護士の経験上から出したのだと思います。
(2) Labor certification PERM process 1 Year (3) Application I140 then I485 – if premium process 15 days, then 0.5 – 1.5 years
また (3)の申請は一般的に時間がかかるところらしいですが、EB2(employment based 2nd)でファイリングを進めるということなので、今のところ申請したら待ち時間がなく申請ができるそうです。ソースはこちらhttps://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2020/visa-bulletin-for-september-2020.html
ちなみに同僚先輩方の中でも同じEB2のGC申請者はいますが、インドや中国籍の方はすごく時間がかかっています。GCが降りるのと自分の墓石の準備が早いのはどちらかな、といつも嘆いています。その他国籍の方々(スイスや韓国)は個人差こそあれどそこまで時間はかかっていないそう。弁護士も日本国籍だから問題はないんじゃないかと楽観的です。
但し皆さんのご意見の通り、COVIDとTrump政権下、雇用ベースはもろに影響を受けやすく通常よりも時間はかかりそうな感じですね。先日H1Bビザに対する新しい規制もでましたよね。
ケース差もあるということですが、家族ベースの方が相対的に確実に早く取れるような雰囲気。皆さんは弁護士に頼らずご自分で進められている方も多く素晴らしいです。
皆さんのご意見も踏まえ、積極的に弁護士と話し合いを進めたいと思います。
