ＤＳを修理屋で壊され、返してもらえないとき

日本語の３ＤＳのフレームが壊れたので、近所のモールにある修理屋にフレーム交換を頼みました。
新しいフレームも持っていき、「１週間でできる」と太鼓判を押されたものの、３ヶ月たった今も戻ってきません。（その間、何度も電話や店頭で催促しました）
どうやら、修理屋さんがスクリーンを壊してしまったようで、もとは使える状態だったのに、今は使えない状態になってしまったようです。
相変わらず、電話で問い合わせても「今、担当者がいないから」、担当者が捕まれば、「実際に修理している者が後で連絡するから」と言う回答でかわされています。
もうそこで直すのは無理だと思ってあきらめていますが、使えない状態にされてしまった日本語の３ＤＳを、アメリカの無責任な修理屋に補償してもらうには、どうしたらいいでしょうか?

口頭で幾ら言っても拉致があかないようですね。
最終的にはスモールクレームコートに持っていけば、お店があるので、妥当な金額の保証はしてもらえるように思います。
いきなりファイルするのではなく、
まず、修理を申し込んだ時に交わした契約書とか受けと取り書などがあると思いますので、そこに書かれてある事を全て把握した上で、正式に書面でこれまでの経緯と修理の情況説明の要求、返却期日見込みなどを書面でｘｘまでに返事して欲しい旨のレターをサーティファイ度メールで送って様子を見ては如何ですか?
その上で、納得の行く回答が無い場合や返答の無い無い場合は、再度、ｘｘまでに納得の行く回答が無い場合は、ｘｘの理由でスモールクレームコートに訴える事を通知し、スモールクレームコートにファイルするのが良いと思います。
とにかく、書面で証拠が残るようにして、書く文章はなるべく理論的に書いた方が有効です。
おそらく、相手がスモールクレームコートにファイルされると思えば、その時点で示談に持っていくと思います。
