The federal government has abrogated the agreement between the United States and the states. The executive branch of the United States has a constitutional duty to enforce federal laws protecting the states, including immigration laws now in effect. President Biden has refused to enforce these laws and has even violated them. As a result, he has set a record for illegal immigration. President Biden has ignored requests from the State of Texas to fulfill his constitutional obligations, even though he was notified by a series of letters, one of which I hand delivered to him.
President Biden violated his oath of office to faithfully enforce the immigration laws enacted by Congress. Instead of prosecuting immigrants for the federal crime of illegal entry, President Biden sent his lawyers to federal court to sue Texas for taking action to secure the border.
President Biden directed agencies to ignore federal laws requiring the detention of illegal immigrants. As a result, mass parole of illegal immigrants to the U.S. was illegally granted.
By wasting taxpayer money to tear up Texas border security infrastructure, President Biden lured illegal immigrants from 28 legal entry points along this state's southern border （ bridges ） where no one drowns, into the dangerous waters of the Rio ・ Grande.
Under President Biden's lawless border policy, more than 6 million illegal immigrants crossed the southern border in just three years. This is more than the population of 33 states in this country. This illegal refusal to protect the states has caused unprecedented harm to people throughout the United States.
James ・ Madison, Alexander ・ Hamilton, and the other visionaries who wrote the U.S. Constitution, did not leave the states at the mercy of a lawless president who would not stop an external threat like the cartels smuggling millions of illegal immigrants across the border. They foresaw that they should not. That is why Article IV, Section 4, which commits the federal government to "protect each （ State ） from invasion," and Article I, Section 10, Clause 3, which recognizes "the sovereign interest of the States to protect their borders," are both included. Arizona v. United States, 567 U.S. 387, 419 (2012)(Scalia, J., dissenting).
The Biden Administration's failure to fulfill the obligations imposed by Article IV, Section 4, triggers Article I, Section 10, Clause 3, which reserves to this State the right to self-defense. For the foregoing reasons, I have already declared an invasion in order to invoke the constitutional authority of the State of Texas to defend and protect itself under Article I, Section 10, Clause 3. This authority is the supreme law of the land and supersedes any federal statute to the contrary. The Texas National Guard, the Texas Department of Public Safety, and other Texas officials are acting pursuant to that authority.
They are acting in accordance with their authority as well as state law to protect the borders of Texas.
