家族

米国移民法は、米国市民および合法的永住者の家族である特定の非市民が、特定の家族関係に基づいて合法的永住者になる(グリーンカードを取得する)ことを認めています。

こちらに該当しない場合は、グリーンカードが申請できる優先移民がカテゴリー分けされているため、確認しておきましょう。

♢第一優先(F1) – 米国市民の未婚の息子および娘(21歳以上)
♢第二優先(F2A) – 合法的永住者の配偶者および子供(未婚で21歳未満)
♢第二優先(F2B) – 合法的永住者の未婚の息子と娘(21歳以上)

米国市民権保持者及び永住権保持者との結婚により永住権を申請する場合がこちらに該当します。

雇用

技能、学歴、職務経験の適切な組み合わせがあれば、雇用に基づく移民ビザを申請することにより、米国に永住し就労できる可能性があります。 雇用ベースの場合、5つのカテゴリに分けられているためどれに該当するかを確認し、証明するものの準備をしておきましょう。

E Visa (E-1 / E-2)

This visa is for trade expatriates and investment expatriates and only those who meet the eligibility requirements can apply.

♢ Eligibility

• Engaged in substantial trade, including trade in services or technology, in eligible activities primarily between the United States and treaty countries engaging in substantial trade, including trade in services or technology, in eligible activities.
• directing the development and operation of an enterprise in which substantial capital has been invested
• Working for an E visa company as an executive, supervisor, or essentially skilled employee.

H Visa (H-1B / H-2A / H-2B / H-3)

This visa is for those who are coming to the U.S. for professional work or when there is no availability of American workers. This visa is for people who are coming to the U.S. for professional work or when U.S. workers are not available. Family members （ accompanying the H visa holder may also apply ） with some restrictions.

L visa (L-1 / Blanket L-1 / L-2)

This visa is for a temporary transfer to a parent company, branch office, affiliate or subsidiary in the U.S. or accompanying family members.

O Visa (O-1 / 0-2)

The O visa is issued to persons of exceptional ability in the sciences, arts, education, business, or sports, or who have demonstrated outstanding achievement in the production of motion pictures or television programs, O visas are issued to persons who have demonstrated outstanding achievement in the sciences, arts, education, business or sports, or in the production of motion pictures or television programs, and to persons who perform ancillary work necessary for the performance of these activities.

P visa (P-1 / P-2 / P-3)

This visa is required for artists and entertainers to lecture, work or teach in the U.S.
