PRESS RELEASE | HERMOSA BEACH CITY COUNCIL ENACTS URGENCY ORDINANCE TO PREVENT ILLEGAL FIREWORKS IN THE CITY

At its regularly scheduled June 25 City Council Meeting, Council voted to enact an Urgency Ordinance that further regulates the illegal use of fireworks in the City of Hermosa Beach. Council approved this Urgency Ordinance, which went into effect immediately, ahead of the 4th of July Holiday, which draws an increase in visitors to the City of Hermosa and its beaches and is often marked by increased incidents involving illegal fireworks.  

In passing the Urgency Ordinance, Council determined that the use of illegal fireworks presented a current and immediate threat to the Hermosa Beach community’s public peace, health, safety and welfare. To address these concerns and protect public safety, the approved Ordinance amends the City’s existing Municipal Code to add language (Chapter 8.42) that prohibits the use, sale and possession of fireworks in Hermosa Beach.  

Council also voted to implement administrative citation fines for violations of the City’s newly adopted firework ordinance. The updated fine schedule for violations is as follows:

1st violation: $1,500

2nd violation: $3,000 


*

3rd violation and beyond: $5,000 

Additionally, a flat $5,000 fine was adopted for violations that involve an individual knowingly allowing fireworks to be used or sold at their residence or on their property. 

Administrative citations can be issued by the Hermosa Beach Police Department. This Urgency Ordinance codifies independent Municipal Code authority on fireworks. Fireworks are also regulated criminally by the California Health and Safety Code and well as the Los Angeles County Fire Code – which is adopted by reference by the City of Hermosa Beach.   

In addition to the recently approved Urgency Ordinance, the Hermosa Beach Police Department will have an increased presence over the 4th of July weekend to ensure safety and security for the entire community. These increased measures include:

Enforcement of Laws Banning Public Intoxication, DUI, Underage Drinking and Drinking on the Beach

Enforcement of Noise Levels

Sizable Fines Invoked for Owners of Properties Requiring More than One Police Response on July 4th
